Husband skips divorce hearing in court due to lack of transportation funds

A Nigerian man, Ali Abubakar has admitted that he skipped his scheduled court appearance in Kaduna because he couldn’t afford the travelling charges due to lack of transportation funds.

Ajinomo Ohunenene-Ummi, his wife, went to court to ask for their marriage to be annulled, but her husband wasn’t there.

Abubakar, who resides in Abuja, had informed the court through Tajuddeen Saidu that he would be unable to attend the hearing because he lacked the finances to go from Abuja to Kaduna.

Her spouse asked the court to follow the petitioner’s requests and continue the proceedings.

Through her lawyer, Nafisa Ibrahim, the petitioner stated that she want to dissolve the marriage and was prepared to pay back the N50,500 dowry that her husband had paid.

Along with custody of their one-year-old child, she asked the court to provide the defendant N20,000 per month in feeding support.

The petitioner and the court messenger were, however, told by the judge, Malam Abdulrahman Isiyaku, to call Abubakar so that he could respond to the accusations.

The court messenger’s report to the judge claimed that Abubakar had agreed to the divorce and child custody arrangements but had also promised to provide his daughter with N10,000 in child support each month.

Abubakar had approved the use of the N50,500 dowry by the complainant as a five-month child-feeding allowance, he said.

When the judge inquired if the complainant approved of the amount, she nodded in agreement.

The marriage was annulled by Isiyaku through the process of Khul’i (redemption), and she ordered the petitioner to keep the N50,500 intended for the dowry return in order to sustain her child for five months.

The judge also ordered Abubakar to keep in charge of the child’s upbringing, clothing, and education until she is old enough to go to school.
