All You Need to Know About the Presidential Election Tribunal

It appears that there are multiple petitions filed against the INEC’s declaration of Tinubu as the winner of Nigeria’s 2023 presidential election.

Both Atiku and Obi are seeking a declaration by the judiciary that they are the lawful winner of the election or a fresh poll.

Obi’s argument is that the February 25th election was invalid due to corrupt practices and non-compliance with the provisions of the Electoral Act.

Obi requests the tribunal to cancel the election and order a fresh one where Tinubu, Shettima, and the APC will not participate.

On the other hand, Atiku is asking for a repeat of the poll or a run-off between him and the Apc candidate, whom he says did not lawfully win the election.

Atiku and his PDP have alleged substantial non-compliance to the constitution, the Electoral Act, and INEC’s election guidelines in the conduct of the election.

The APC, in response, has asked the Presidential Election Petition Tribunal to dismiss the petitions by Obi and the Labour Party and Atiku and PDP against Tinubu for being incompetent and lacking in locus standi.

The APC and Tinubu cite an alleged breach of the mandatory provision of section 77(3) of the Electoral Act, 2022 by Obi and his party.
